Cardholder Account Agreement
These Terms and Conditions (hereinafter, the “Terms”) constitute a legally binding agreement between the customer (the “Cardholder,” “you,” “your”) and the authorized provider supporting the operation of the SCAP Card program.

SCAP Card is a trademark identifying a financial services program promoted by SCAP Card, operated under the legal and technological infrastructure of duly registered and authorized entities. The program enables the issuance of prepaid cards and access to functions such as digital payments, withdrawals, conversions between fiat and crypto assets, and digital value storage.

For the development of this program, SCAP Card collaborates with licensed financial and technological service providers. The issuance and operation of the cards, as well as transaction processing and fund management, are conducted by these entities under valid service agreements and applicable laws.

When credit or prepaid card-related services are offered within the program, the corresponding terms, conditions, and policies of the regulated provider operating the infrastructure apply. This includes, but is not limited to: deposit and withdrawal options, cryptocurrency custody, and digital-to-fiat currency conversion. Such services are offered exclusively under the contractual and regulatory framework of the authorized provider.

Pre-Use Legal Notice – SCAP Card
Read this agreement carefully before using your SCAP Card. This document, along with your application and validation, constitutes the applicable Terms and Conditions for the use of your prepaid card.

By requesting, activating, and using your SCAP Card, you acknowledge that you have read and understood these Terms and expressly agree to the conditions described herein, as well as the inherent risks of using the product, particularly those related to electronic transactions and digital asset operations.

If you do not understand any provision or disagree with any part of the content, we ask you to contact SCAP Card support using the contact details specified in Clause 20 of this document before proceeding with card use.

To access this product, you must be at least 18 years old.

3. DEFINITIONS

“Account”
The electronic account associated with your SCAP Card, through which balances, transactions, and settings are managed.

“Account Holder”
You, the natural person who accepts these Terms and accesses the SCAP Card program.

“Agreement”
This Terms and Conditions document, which may be updated occasionally by the program operator.

“Application”
The personal information and data provided by you to apply as an SCAP Cardholder.

“Associated Entity”
The licensed financial institution responsible for issuing and processing the card under the SCAP Card program.

“Available Balance”
The amount of electronic money loaded and available for use through your SCAP Card.

“Automated Teller Machine (ATM)”
Automated terminal for withdrawals or balance inquiries that accepts cards within the program’s corresponding network.

“Card”
The SCAP Card issued under this program, in physical or digital format, for authorized transactions.

“Card Number”
The number printed or electronically assigned to your SCAP Card, required to process operations.

“SCAP Card Support”
The authorized team for managing inquiries and requests related to your card. Contact details are available in Clause 20 of this Agreement.

“Fee and Limits Schedule”
Document detailing applicable fees, charges, and limits for card use, incorporated as part of this Agreement (see Clause 11).

“Interactive Voice Response (IVR)”
Automated phone service for card activation and other basic support functions.

“Merchant”
Individual or legal entity accepting payments via cards operating under the SCAP Card program’s authorized network.

“Password”
Key created by you to securely access your account via the web or mobile platform.

“Program Manager”
The entity responsible for marketing, distribution, and customer service of the SCAP Card program, acting as an intermediary between the user and the issuing entity.

“PIN”
Personal Identification Number authorizing transactions made with the card.

“Transaction”
Any operation performed using your SCAP Card, including purchases, ATM withdrawals, transfers, third-party payments, or balance top-ups.

“We,” “our,” or “the Company”
The authorized operator of the SCAP Card program and its associated entities providing licensed services.

“You” or “your”
The SCAP Card Account Holder.

“Website”
The official platform for managing the cardholder’s account: www.scapcard.com.

2. SCOPE OF THIS AGREEMENT

2.1. These Terms and Conditions are drafted and available solely in English. All official communication regarding the use, support, or management of your SCAP Card will also be conducted in English.

3. ACQUISITION, DELIVERY, AND CARD ACTIVATION

3.1 The user may only request one active SCAP Card at a time. This card is personal, non-transferable, and must be used exclusively by the registered Cardholder, per these Terms and Conditions.

3.2 The card will be issued based on the information provided by the user during the application process. You agree to provide truthful personal data and promptly notify any changes to keep your information updated in our records. Changes must be made via the profile link on the program’s website.

3.3 If your identity cannot be satisfactorily verified with the provided information, your application will be suspended until additional required documentation is completed and validated.

3.4 The card will be delivered within approximately 7 to 10 business days from the formal approval of your application.

3.5 Upon receiving the card, you must activate and identify it in the system immediately to begin use.

3.6 The card may be used for ATM cash withdrawals and to authorize transactions at chip-enabled point-of-sale terminals. In both cases, your PIN will be required.

3.7 For security reasons, you must not share your PIN with anyone. The SCAP Card program will never disclose your PIN to third parties under any circumstances. If forgotten, you may reset it by contacting support. You are responsible for keeping your PIN separate from the card and any document containing your card number. Non-compliance will be considered gross negligence and may limit your right to file claims for losses.

3.8 You may change your PIN at ATMs that allow it. When doing so, avoid easily predictable codes such as:
(a) numbers related to your personal life (e.g., birthdate or phone number);
(b) combinations visible on the card itself;
(c) repetitive or sequential patterns (e.g., 1111 or 1234);
(d) or a code identical to a previously used one.

4. CARD USE

4.1 Your SCAP Card can be used at any merchant accepting cards in the corresponding network. However, not all merchants may accept the card for a specific transaction.

4.2 The card may be used for cash withdrawals at ATMs displaying authorized acceptance marks, as well as at affiliated banks allowing cash advances. Some ATMs or merchants may apply lower limits than those set by this Agreement. Additional fees may apply depending on the ATM provider.

4.3 SCAP Card functions as a prepaid or limited-credit card, meaning the Available Balance will be reduced by the total amount of each transaction or authorization, including taxes, associated charges, and any additional withdrawal fees. This “Total Deductible Amount” must be equal to or less than the Available Balance at the time of the operation.

Do not use your card if the Total Deductible Amount exceeds your Available Balance or if the card has expired. If a transaction is processed for an amount greater than the balance, you must repay the difference within no more than 14 calendar days from receiving the notification or invoice. Non-compliance may result in collection actions, including legal measures.

4.4 You may check your Available Balance via the official website or by contacting SCAP Card support. Fees may apply for this service.

4.5 For security reasons, all merchants accepting the card must request online authorization to validate the transaction. In some cases, the merchant may require the available balance to exceed the final purchase amount. Only the actual transaction value will be charged. Below are common examples:

4.5.1 Hotels and vehicle rentals: May request authorization above the estimated cost due to potential additional charges.

4.5.2 Restaurants: Must have an available balance for the total consumption plus up to 20% additional to cover service charges.

4.5.3 Online merchants: Some websites may perform verification authorizations upon registration or at checkout, which may temporarily affect your balance. In many cases, the final charge is applied only when the product is shipped.

4.5.4 In-flight or onboard purchases: If the merchant cannot access the online authorization system (e.g., on planes or cruises), the transaction may be declined.

4.5.5 Memberships and subscriptions: For recurring payments, maintain sufficient balance to avoid rejections or service interruptions.

4.6 The Available Balance on your SCAP Card does not accrue interest.

4.7 The program operator may request the card’s return at any time for justified reasons under this Agreement (see Clause 15). In such cases, the available balance will be refunded without a redemption fee (see Clause 7).

4.8 For returns on products or services paid with your card, you agree that refunds will be processed as credits to your SCAP Card.

4.9 Restrictions and prohibited transactions: The program operator reserves the right, at its sole discretion, to add new categories of prohibited use by amending this Agreement or publishing an acceptable use policy on the official website.

4.10 It is strictly prohibited to use the card for illegal purposes, including—but not limited to—fraud, money laundering, or evasion of commercial restrictions imposed by merchants. All suspicious activity will be reported to the relevant authorities.

4.11 We reserve the right to close inactive accounts after more than three (3) months from card activation.

5. LOADING FUNDS TO YOUR ACCOUNT

5.1 Product Nature and Fund Authorization
Your SCAP Card is linked to a digital account allowing electronic fund transfers from authorized sources, including employers, payment platforms, business partners, financial providers, and verified allied entities (“Authorized Payers”).

Funds may be deposited recurrently or sporadically, whether as payroll, commissions, withdrawals from connected platforms, remittances, or other valid compensation.

For doubts or inconsistencies about funds loaded to your account, we recommend contacting the provider that originated the payment directly.

5.2 Fund Availability and Corrections
Loaded funds will be available once their crediting is confirmed by the Authorized Payer and processed by SCAP.

You authorize SCAP and Authorized Payers to correct evident transfer errors, including returns or adjustments if funds were incorrectly credited.

If additional information about received funds is required or an error is detected, you must notify the corresponding Payer immediately.

You are responsible for maintaining an updated record of funds loaded to your account and complying with applicable tax regulations in your country of fiscal residence, including income declaration and payment of local, national, or international taxes that may arise.

5.3 Right to Temporary Suspension
SCAP reserves the right to temporarily suspend the functionality of loading funds to your card in cases such as:
• Breach of these terms.
• Reasonable suspicion of unusual or fraudulent activity.
• Regulatory or compliance requirements.

When possible, SCAP will notify the user in advance of such suspensions, unless legal or security reasons justify omitting prior notice.

6. CARD EXPIRATION

6.1 Expiration Date
The expiration date of your SCAP Card is printed on the card’s front. You may not use the card after its expiration.

Unless indicated otherwise, a new card will be automatically issued and sent before the current one expires.

6.2 Non-Renewal by SCAP
SCAP may decide not to renew your card upon expiration. In such cases, you will be notified at least 30 days in advance of the expiration date.

6.3 Post-Expiration Transactions
No transactions will be processed with an expired card. To continue operating, you must activate a new valid card.

7. ELECTRONIC FUND REDEMPTION

7.1 The Cardholder may request a refund of unused funds available on their SCAP Card by contacting SCAP Card Support through authorized channels.

7.1.1 A redemption fee will apply, as stipulated in the “Fee and Limits Schedule” valid at the time of the request.

7.2 SCAP Card may require identity verification and other reasonable security controls before processing any refund request to prevent fraudulent or improper card use.

8. CARDHOLDER RESPONSIBILITIES AND AUTHORIZATIONS

8.1 SCAP Card may restrict or reject any transaction if it deems the card’s use is causing, or may cause, a violation of these Terms and Conditions, or if there are reasonable grounds to suspect the Cardholder or a third party has committed, or attempted to commit, a crime or abuse related to the card.

8.2 If a transaction requires investigation, the Cardholder must fully cooperate with SCAP Card, its authorized partners, or any competent authority.

8.3 The Cardholder agrees not to:
(a) allow another person to use their card;
(b) record the PIN or password in physical or electronic format;
(c) disclose their PIN or password to third parties by any means;
(d) enter their PIN at ATMs that appear altered, modified, with suspicious devices, or operating irregularly.

8.4 If a transaction requiring the use of the PIN is completed, it will be deemed authorized by the Cardholder, who will be responsible for such a transaction.

8.5 The Cardholder agrees to indemnify and hold harmless SCAP Card, as well as its distributors, partners, agents, sponsors, and service providers, from any costs arising from legal actions necessary to enforce these Terms or from any fraudulent use of the card, PIN, or password by the Cardholder or with their authorization.

9. LOSS, THEFT, OR DAMAGE TO THE CARD

9.1 The electronic balance on the SCAP Card must be treated as cash. If the card is lost or stolen, the balance may be lost in the same way as misplaced cash.

9.2 In case of loss, theft, fraud, damage, or other situations involving the risk of unauthorized card use, the Cardholder must immediately contact SCAP Card support and provide the card number and identification data.

The Cardholder will be responsible for unauthorized transactions made before notifying SCAP Card, which will be deducted from the available balance.

If there is still an available balance and no fraudulent conduct or gross negligence by the Cardholder is detected, SCAP Card will issue a replacement card and transfer the available balance to it.

Replacement fees will apply as stipulated in the Fees section (see Clause 11).

9.3 The Cardholder agrees to cooperate with SCAP Card, its partners, and relevant authorities in case of suspected misuse, loss, or theft of the card.

10. FOREIGN CURRENCY TRANSACTIONS

10.1 If the Cardholder performs a transaction in a currency other than the base currency selected at the time of card application, the corresponding amount will be converted to the base currency on the day SCAP Card receives the transaction details.

The conversion will use the exchange rate set by the processing network (Association), which includes a foreign currency conversion fee (see Clause 11).

The Cardholder accepts that exchange rates may fluctuate, so the amount deducted from the available balance may vary between the time of the transaction and when the charge is reflected.

11. FEES AND PRODUCT SUMMARY

11.1 The use of the SCAP Card is subject to the fees and restrictions outlined in the “Fee and Limits Schedule,” which is an integral part of this Agreement and may be updated periodically. Any changes will be duly notified to the Cardholder through official channels.

11.2 SCAP Card may deduct from the available balance any applicable taxes or charges related to product use.

11.3 Monthly maintenance fees and/or inactivity charges, if applicable, will be automatically deducted from the Cardholder’s account balance each monthly period.

12. DISPUTES

12.1 If the Cardholder believes a transaction was unauthorized or incorrectly charged to their account, they may request a review by contacting SCAP Card support within 30 days of the transaction date.

The request must be submitted in writing, detailing the disputed transaction, the reasons for disputing it, and attaching copies of relevant receipts. SCAP Card will assist as much as possible, provided the Cardholder has made reasonable efforts to resolve the dispute directly with the involved merchant.

12.2 If the investigation concludes the transaction was erroneous or unauthorized, the corresponding amount will be refunded to the Cardholder’s account.

During the review process, the disputed amount will be withheld and cannot be used. If the transaction is confirmed as legitimate, the value will be debited again.

If the Cardholder lacks sufficient funds to cover this charge, they must repay it to SCAP Card immediately upon request.

SCAP Card reserves the right to apply a dispute handling fee, as stipulated in the “Fee and Limits Schedule.”

12.3 SCAP Card reserves the right to deny refunds if the Cardholder is found to have breached these Terms and Conditions.

12.4 No refunds will be granted for cards with a “Shipped” status, as they were explicitly requested by the Cardholder. It is the Cardholder’s responsibility to ensure the registered shipping address is correctly written in Latin characters and corresponds to their actual residence.

13. AGREEMENT MODIFICATIONS

13.1 SCAP Card may modify these Terms and Conditions, including fees, charges, and limits, at any time by publishing an updated version on its official website. Modifications may be made for reasons including but not limited to:

13.1.1 To reflect the implementation of new systems, operational methods, services, or functionalities;

13.1.2 To adapt to actual or anticipated market changes, industry practices, or costs associated with service provision;

13.1.3 To comply with or anticipate legal, tax, or regulatory changes, codes of best practices, or recommendations from regulatory authorities;

13.1.4 To ensure prudent operation and maintain service competitiveness;

13.1.5 To incorporate judicial or regulatory decisions;

13.1.6 To make terms clearer, fairer, or more understandable for the Cardholder;

13.1.7 To correct errors detected subsequently;

13.1.8 By mutual agreement with the Cardholder;

13.1.9 To harmonize banking interests or billing structures.

13.2 The Cardholder must regularly review the SCAP Card website for potential updates. Continued use of the card after modifications are published constitutes express acceptance of the new terms. If the modifications are not accepted, the Cardholder must cease card use immediately.

13.3 If a modification significantly affects the Cardholder, they may cancel the product per the current cancellation policy. In such cases, no cancellation fee will apply.

14. CANCELLATION

14.1 The Cardholder may cancel their SCAP Card for any reason:
(a) before activation, or
(b) within 14 calendar days after the activation date (the “Cancellation Period”).

This right does not apply to additional or replacement cards for which this period has expired.

14.2 If canceled within the Cancellation Period, SCAP Card will refund the available balance on the card within 30 days of the request. No fees will apply for this cancellation.

14.3 After the Cancellation Period, the Cardholder may terminate the card at any time by exercising their rights under Clause 15.3.

15. SERVICE TERMINATION OR SUSPENSION

15.1 SCAP Card may terminate this Agreement at any time:
(a) with 30 calendar days’ notice and a refund of the available balance;
(b) immediately if the Cardholder breaches these Terms and Conditions, or if SCAP Card has reasonable grounds to believe the card has been, or will be, used negligently, fraudulently, or unlawfully, or if transactions can no longer be processed due to third-party actions or suspension under Clause 15.2.6;
(c) immediately if other serious grounds justify termination.

15.2 SCAP Card may suspend card use immediately (until the situation is resolved or the Agreement is terminated) in the following cases:

15.2.1 Due to failures or errors in the transaction processing system;

15.2.2 If card data is suspected to be compromised;

15.2.3 If information provided during registration is found to be incorrect;

15.2.4 If a transaction is declined due to insufficient available balance;

15.2.5 In case of breach of this Agreement or reasonable suspicion of negligent, fraudulent, or unlawful use, or inability to process transactions due to third parties;

15.2.6 Due to fraudulent or suspicious account activity;

15.2.7 For any other serious justifying reason;

15.2.8 If required by law or a competent government authority, or to comply with financial crime prevention or illegal activity recommendations;

15.2.9 If the card remains inactive for three (3) consecutive months, the issuer may cancel the card and close the account. To reactivate the service, the Cardholder must request a new account and comply with current registration conditions.

15.3 The Cardholder may terminate this Agreement at any time after the Cancellation Period by contacting SCAP Card support.

16. OUR LIABILITY

16.1 SCAP Card’s liability under this Agreement (whether arising from contract, tort, breach of legal duty, or otherwise) is subject to the following exclusions and limitations:

16.1.1 SCAP Card is not liable if the Cardholder cannot use their card for reasons specified in this Agreement, or due to loss, theft, damage, malfunction, or causes beyond SCAP Card’s reasonable control;

16.1.2 SCAP Card is not liable if a merchant refuses to accept a transaction or fails to cancel a prior authorization;

16.1.3 SCAP Card is not liable for goods or services purchased by the Cardholder with the card;

16.1.4 SCAP Card assumes no liability for failures attributable to external causes, including but not limited to: insufficient funds, ATM network failures, limits imposed by ATM operators, or processing system failures;

16.1.5 SCAP Card is not liable for lost profits, business loss, or indirect, consequential, special, or punitive damages;

16.1.6 If the card malfunctions due to SCAP Card’s fault, liability is limited to replacing the card or, at SCAP Card’s option, refunding the available balance;

16.1.7 If incorrect deductions from the available balance are attributable to SCAP Card, liability is limited to refunding the equivalent amount in the Cardholder’s base currency;

16.1.8 In any other case attributable to SCAP Card, liability is limited to refunding the available balance;

16.1.9 SCAP Card is not liable for disputes between the Cardholder and third parties (e.g., payers, payment processors, receiving banks) regarding the amount or timing of fund loading. Such disputes must be resolved directly between the involved parties.

16.2 No provision of this Agreement limits or excludes SCAP Card’s liability for death or personal injury resulting from its negligence or fraud.

16.3 To the extent permitted by law, all implied warranties or conditions by law, regulation, or other sources are expressly excluded.

16.4 The above exclusions and limitations also apply to any liability of the processing network, providers, contractors, agents, or distributors of SCAP Card.

17. YOUR PERSONAL INFORMATION

17.1 The Cardholder may be required to provide personal data related to SCAP Card use. Some data is necessary to offer the product and associated services. Any name or address changes must be notified immediately to SCAP Card support.

17.2 SCAP Card commits to protecting the Cardholder’s personal data per applicable data protection laws, adopting reasonable measures to prevent unauthorized access, loss, disclosure, or improper destruction of information.

Unless required by law or contemplated in this agreement, personal information will not be shared without the Cardholder’s authorization.

Under anti-money laundering regulations, SCAP Card may request identification documents and verify this information through specialized identity validation or credit reference agencies, which may record such inquiries.

17.3 The Cardholder authorizes SCAP Card to use their personal data for card and electronic money use, including operational contacts (e.g., replacement card issuance) and product improvement, development, and analysis.

This information may be shared with agents, contractors, providers, distributors, and the processing network (Association) for statistical, transactional, or compliance analysis, per the privacy policy.

Personal data may also be used or shared for marketing or transferred outside the Cardholder’s country of residence (including non-EEA countries) to enable global card use. Such countries may not have equivalent protection standards.

SCAP Card may disclose personal data when required by law, regulation, or competent authorities investigating potential illegal or unauthorized activities.

17.4 The Cardholder has the right to access personal information retained by SCAP Card and may request its review. An administrative fee may apply for this request. For details, contact support.

17.5 If SCAP Card detects incorrect or falsified personal data, it may suspend or cancel the card until information veracity is confirmed, to protect both parties.

17.6 The Cardholder is solely responsible for keeping their personal information updated in SCAP Card’s records.

17.7 The Cardholder may request a full copy of SCAP Card’s data protection policy at any time.

18. COMPLAINT PROCEDURE

18.1 Any complaint regarding SCAP Card services must be emailed to authorized support.

18.2 All complaints will be handled per SCAP Card’s official Complaint Procedure. The Cardholder may request a copy of this procedure at any time.

18.3 The Cardholder agrees that any claim, dispute, action, proceeding, liability, or complaint must be directed exclusively to SCAP Card and limited to matters related to:
– card use or misuse,
– executed or failed transactions,
– support received, and
– generally, any rights under this Agreement.

The Cardholder irrevocably agrees that all rights are enforceable solely against SCAP Card, which is solely responsible to the Cardholder for fulfilling or breaching obligations under this contract.

19. GENERAL PROVISIONS

19.1 SCAP Card’s omission or delay in exercising any right or remedy under this Agreement will not be construed as a waiver or hinder its subsequent exercise.

19.2 If any provision of this Agreement is deemed invalid, illegal, or unenforceable by a competent authority, the remaining provisions will remain in full force and effect.

19.3 The Cardholder may not assign or transfer any rights or obligations under this Agreement. The Cardholder is the sole contracting party with SCAP Card and remains responsible until the card is canceled or expires and all pending financial obligations are fully settled.

SCAP Card may assign or transfer its rights and benefits at any time without prior notice to the Cardholder and may subcontract any obligations without requiring express authorization.

19.4 No third party not part of this Agreement may enforce rights or obligations under it, except as expressly provided, such as the right of designated providers in Clause 16.4 to enforce the liability limitations therein.

Note: The ATM operator or network may apply additional fees, even for balance inquiries without completing a transaction.
